TERMS AND CONDITIONS

LIVE PERFORMANCE TERMS AND CONDITIONS

Patrons must review and accept the following Terms and Conditions with respect to attending live performances during the 2024 Stratford Festival Season:

  1. All performances are subject to restrictions imposed in response to COVID-19 by governmental and public health authorities and to cancellation or modification at the discretion of the Stratford Festival should extenuating circumstances arise in relation to COVID-19.

  2. In the event a performance is cancelled or rescheduled, Patrons are entitled to exchange or return their ticket for a future performance or a Stratford Festival credit as set out in the Terms of Purchase (accessible here).

  3. Provided that the number of tickets to a performance sold exceeds the number of attendees permitted to attend a performance as mandated by governmental and public health authorities in response to COVID-19 at the time of the performance, the Stratford Festival shall offer to the Patron a monetary refund or an exchange of the ticket for a future performance or a Stratford Festival credit.

  4. Patrons must consent to on-site COVID-19 screening and tracing protocols as mandated, from time to time, by the public health authorities and the Stratford Festival. The Stratford Festival reserves the right to decline admittance to any individuals who present symptoms related to COVID-19 or fail the on-site screening protocols.

  5. Patrons must comply with and abide by all COVID-19 measures mandated, including but not limited to being fully vaccinated and the use of masks covering both the nose and mouth in their entirety. The Stratford Festival reserves the right to decline admittance to any individuals who fail to abide by any such mandates or requirements without a valid exemption.

  6. Patrons shall release, indemnify, and save harmless the Stratford Festival, along with the directors, officers, employees, agents, and assigns thereof (the “released parties”), from and against any and all losses, claims, shortages, damages, liabilities, fines, penalties, expenses, including future claims of any type, arising, directly or indirectly, from the Patrons’ attendance at the premises of the Stratford Festival for the performance, expressly including any such liabilities arising out of or related to or caused, either directly or indirectly, by COVID-19.

  7. Patrons authorize and irrevocably consent to permit the Stratford Festival to use their image, voice, and/or comments in any manner or for any purpose, including but not limited to use in promotional materials, and expressly release the Stratford Festival from any liability arising in connection with said permitted use.

  8. Patrons must abide by all Stratford Festival policies, including those relating to late entry, behaviour, the use of electronic and recording devices, and general refusals of admission as set out on the “Ticketing” and “Visiting” pages (accessible here and here).


TERMS OF PURCHASE

Refund Policy

Ticket sales are non-refundable, however they may be exchanged or returned for a credit subject to the Ticket Policies outlined below.

Patrons may request a refund for up to thirty (30) days from the date of purchase on all retail purchases, excluding gift certificates, tickets, and digital products, including those purchased on demand.

All items must be returned unopened and in their original packaging. The Stratford Festival Shop reserves the right to inspect and verify the condition and saleability of returned products prior to issuing a refund. Promotional discounts have no monetary return value and are not subject to refund.

Patrons are responsible for return shipping costs and must ensure that the returned product is packaged safely and arrives to the Stratford Festival Shop in a good and saleable condition. The Stratford Festival Shop assumes no liability with respect to lost or damaged goods if such loss or damage occurs during return shipping.

Shipping costs are non-refundable unless the product is defective upon arrival or there has been an error on the part of the Stratford Festival Shop in fulfillment of the order.

Limited Warranty

The Stratford Festival Shop’s sole responsibility for warranty claims is limited to the refund policy as set out herein. Save and except for the refund policy the Stratford Festival and the Stratford Festival Shop make no warranty, representation, or guarantee respecting any new product, whether express or implied, including, without limitation, warranties of merchantability or fitness for purpose.

Limitation of Liability

In no event shall the Stratford Festival or Stratford Festival Shop be liable to the Patron for any special, direct, indirect, consequential, or punitive damages, losses, injury, costs, or expenses of any nature related to any product.

The Stratford Festival and Stratford Festival Shop’s total aggregate liability to the Patron for any and all claims, whether in contract, tort, warranty, or otherwise, shall be limited to the purchase price of such product plus $5.00 CDN in respect of shipping charges where applicable.

Ticket Policies

Ticket purchases are not subject to monetary refund but may be exchanged for a future performance in the same season, or returned for Stratford Festival credit. All ticket exchanges or returns are subject to an administrative charge of $8.10 CDN per ticket, which will be waived at the discretion of the Stratford Festival in the event Patrons are required to self-isolate or in the event of a COVID-related illness.

Patrons to any performance during the 2024 Stratford Festival Season must review and accept the Stratford Festival’s “Live Performance Terms and Conditions” prior to purchase and as a pre-condition of attendance at the performance (accessible here).

Trademarks, copyrights, linked websites, collection of information, user contributions, prohibited content, unauthorized use, violation of terms 

The services and content provided by Stratford Festival and stratfordfestival.ca are subject to the following Terms of Use (the "Terms"). By using or visiting stratfordfestival.ca (known as the "Site"), you agree to be bound by the Terms and to follow the Terms and all applicable laws and regulations governing the Site. The Stratford Festival and stratfordfestival.ca reserves the right to change these Terms at any time, effective immediately upon posting on the Site. Please check this page periodically. If you violate the Terms, the Stratford Festival may terminate your use of the Site, bar you from future use of the Site, cancel your ticket order, or take appropriate legal action against you. 

Trademarks 
The Stratford Festival, a registered trademark of the Stratford Festival of Canada, owns and operates the Site. The Stratford Festival, stratfordfestival.ca, and all other names, titles, logos, and designs identifying the brand of the Stratford Festival, including any derivative and related names, titles, logos, and designs, are trademarks and the sole property of the Stratford Festival. All other names, titles, logos, and designs appearing on this website are the property of their respective owners. 

Copyrights 
The Stratford Festival provides access to a variety of resources including, but not limited to, text, photographs, graphics, images, illustrations, audio and video clips, logos (collectively, the "Content") that are protected by copyright as a collective work and/or compilation under the Canadian copyright laws, international conventions, and other copyright laws. 

Any reproduction, modification, publication, transmission, framing, misuse, transfer, sales, or distribution of the Content of the Site is prohibited unless prior consent is obtained by the Stratford Festival. Notwithstanding the foregoing, use of these resources may be used by our media affiliates for promotion and news purposes during the current Stratford Festival season but must not be archived for future use. Use of these resources after the last performance of the season must meet prior approval of the Festival and is subject to terms of collective agreements and other conditions that may be placed on them by the Festival. Legal notices and or credits on content, such as footage, photographs, images, and logos, must not be removed.

As a service to visitors of the Site, links or references to third party sites throughout the World Wide Web may offer products, software, materials, or services that the Stratford Festival has no control over and accordingly cannot guarantee, represent, or warrant that the content contained in these sites is accurate, legal, or inoffensive. We recommend that you view the Terms posted on each site to confirm that the sites' policies are acceptable to you. By using stratfordfestival.ca to link to other sites, you agree that your decision to access other websites is entirely at your own risk and discretion, and understand that you may not make any claim against the Stratford Festival for any damages or losses resulting from your use of the Site to link to other sites. 

Collection of information 
The collection of personal information about you is not practiced by the Site unless you knowingly provide us with this information through making a financial contribution/donation, ordering Stratford Festival tickets, contest promotions, subscribed newsletters, online bulletin boards, chat areas, or other interactive, online activities. Personal information may include your name, address, phone number, credit card numbers and expiry dates, age and e-mail address. 

We may place a temporary "cookie" on your hard drive that will enable you to make use of our online ordering service. If you set your Internet browser to decline acceptance of cookies, you may experience technical difficulties when using our online ordering service.
